Terms of Service

These Terms govern the CosmiQ website, web application, and mobile applications (the “Service”). By accepting these Terms, you enter a binding agreement with Cosmiqapp. Our Privacy Notice explains how we handle personal information; acknowledging it is not consent to every optional use.

You must be at least 18, have reached the age of majority where you live, and be legally able to enter this agreement. Do not create an account for someone else without authority.

CosmiQ provides AI-assisted tarot, astrology, dream interpretation, reflective conversation, meditation, and related creative content for entertainment, education, personal reflection, and creative exploration.

CosmiQ does not know, determine, or predict future events or outcomes. Tarot selections, astrological calculations, timing windows, “Psychic” mode, dream interpretations, and AI-generated statements are symbolic and speculative—not facts, guarantees, prophecies, or evidence that something will happen.

The Service is not medical, mental-health, crisis, legal, financial, investment, tax, employment, relationship, safety, or other professional advice. Do not use it to diagnose or treat a condition, decide whether to seek care, make an emergency or safety decision, determine legal rights, place a bet or investment, make a major financial decision, surveil another person, or replace a qualified professional and reliable evidence.

If someone may be in immediate danger or experiencing a crisis, contact local emergency services or an appropriate crisis service. CosmiQ does not provide emergency monitoring.

You are interacting with automated AI systems. Outputs can be wrong, fabricated, incomplete, inconsistent, offensive, or unsuitable. Verify important information independently. You remain responsible for your decisions and actions.

We use safeguards intended to reduce harmful, coercive, deceptive, dependency-forming, and high-risk content, but safeguards are imperfect. We may refuse, redirect, or limit a request for safety, legal, or operational reasons.

Do not treat CosmiQ as conscious, supernatural, emotionally dependent on you, or uniquely able to understand you. It cannot access another person’s thoughts, private conduct, or intentions, and it cannot verify paranormal claims.

Provide accurate registration information, protect your credentials, and promptly report suspected unauthorized access. You are responsible for activity under your account unless applicable law provides otherwise. Google and Apple sign-in are optional third-party authentication methods, and their terms also apply to those accounts.

You retain ownership of content you submit. You give CosmiQ a non-exclusive, worldwide, royalty-free licence to host, copy, transmit, transform, and process it only as reasonably needed to provide features you request, store or share content as you direct, secure and support the Service, comply with law, and exercise or defend legal rights, subject to our Privacy Notice and your controls. This is not permission to sell your content.

You must have the rights and permissions needed for submitted content. Only provide another person’s name, image, birth details, or other information when you have authority and any required permission. Do not use outputs to impersonate, defame, harass, deceive, diagnose, make eligibility decisions about, or invade the privacy of another person.

Regular chats are saved until you delete them or the account, subject to the retention exceptions in our Privacy Notice.

Memory is on by default for regular chats and can be turned off in Settings. Turning it off stops future learned-memory retrieval and updates but does not delete existing learned memory. “Clear learned memory” deletes learned-memory layers, not saved chats. Deleting a source chat also removes memory learned from it. CosmiQ is designed not to save restricted learned-memory claims involving medical information, crisis or self-harm, legal matters, sexuality, trauma, abuse, or unnecessarily private third-party details.

Temporary Chat is not placed in normal history or learned memory. CosmiQ and its providers still temporarily process the prompt, response, and job data needed to deliver it. Normal application records are deleted after the session; abandoned temporary chats are eligible for deletion after 24 hours. Provider retention may be longer.

If you create a share link, anyone who obtains it can view, copy, and redistribute the content until the link expires or is revoked. Anonymous sharing only controls whether your displayed name appears. Review the content and remove information you do not want others to see.

Some features require a recurring CosmiQ+ subscription or separately purchased credits. Before purchase, we show the plan or pack, currency, price, billing frequency, included allowance, and other material terms. Taxes and currency conversion may apply.

Web payments are processed by Stripe. iOS subscriptions are processed under Apple’s App Store terms and managed through your Apple account; RevenueCat synchronizes entitlement status.

Subscriptions automatically renew for the displayed period until cancelled. You authorize the applicable provider to charge the payment method on file. We may change prices prospectively after any notice required by law or platform rules.

Purchased credits are not money, are not transferable or redeemable for cash, and expire 12 months after purchase unless mandatory law requires otherwise. Promotional or included allowances may have shorter reset or expiry periods disclosed in the Service.

You can cancel a web subscription through CosmiQ’s billing controls. App Store subscriptions must be cancelled through Apple. Cancellation stops future renewal; paid access normally continues until the end of the current period unless the purchase disclosure, provider rules, or law says otherwise.

Account deletion immediately deactivates the account and attempts to stop web renewal. You may choose immediate permanent deletion or a 30-day recovery period. Signing in during recovery restores the account but does not restart cancelled billing. See Account deletion for details.

Payments are generally final once the digital service or credits are supplied, but this is not an absolute no-refund rule. We provide refunds where required by consumer law, app-store or payment-provider rules, or an express purchase promise, and may grant other refunds at our discretion. Contact cosmiqapp@gmail.com promptly with the account email and transaction details. Nothing here limits non-waivable remedies for a service that is defective, misdescribed, or not supplied.

You must not:

• use the Service unlawfully or violate another person’s rights;
• threaten, exploit, harass, stalk, discriminate against, or endanger anyone;
• seek sexual content involving minors or non-consensual sexual content;
• use the Service for consequential decisions about another person’s employment, housing, credit, insurance, education, health, legal rights, or access to services;
• upload malware, probe security, evade limits, scrape at scale, interfere with operation, or access another account;
• misrepresent an AI output as verified fact or professional advice; or
• infringe rights, unlawfully resell the Service, or use outputs to train a competing model where prohibited by law.

We may investigate, remove content, restrict features, suspend or terminate accounts, and preserve or disclose records where reasonably necessary for safety, security, enforcement, or law.

The Service, software, design, branding, curated materials, and non-user content belong to CosmiQ or its licensors. We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service under these Terms.

Subject to rights in your input, third-party material, and these Terms, you may use output for any lawful purpose. AI output may not be unique, may resemble output given to others, and may not qualify for intellectual-property protection. Feedback may be used without restriction or compensation, while personal information remains subject to our Privacy Notice.

The Service relies on AI, hosting, authentication, payment, app-store, job-processing, maps, search, notification, and other providers. Their outages, terms, and retention can affect availability. External search results and links are not CosmiQ endorsements.

We may change or discontinue features and limits, fix errors, or suspend service for maintenance, security, or legal reasons. We do not promise uninterrupted availability. Mandatory rights and specific purchase commitments continue to apply.

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and do not warrant that output is accurate, predictive, safe for a particular decision, or error-free.

To the maximum extent permitted by law, CosmiQ is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss; lost profits, data, or goodwill; or decisions made in reliance on output. Our total liability arising from the Service will not exceed the greater of the amount you paid for the Service in the previous 12 months and CAD $100.

These exclusions do not apply where prohibited, including non-waivable liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer and privacy rights.

To the extent permitted by law, you are responsible for reasonable losses and third-party claims caused by your unlawful use, infringement of another person’s rights, or material breach of Sections 5 or 10. You do not indemnify CosmiQ for our own breach, negligence, or unlawful conduct.

You may stop using the Service and request deletion at any time. We may suspend or terminate access where reasonably necessary for a material breach, fraud, abuse, safety or security risk, non-payment, legal requirement, or discontinuation. Where practical and lawful, we will give notice and an opportunity to correct the issue.

Contact us first so we can try to resolve a concern. These Terms are governed by Ontario law and applicable federal Canadian law. Ontario courts have non-exclusive jurisdiction.

This choice does not remove mandatory protections or a right to bring a claim in your home forum where it cannot be waived. These Terms do not require private arbitration and do not waive class-action rights.

We may update these Terms and will identify the effective date. We will provide notice appropriate to the change and ask authenticated users to accept material changes where appropriate or required. We will not retroactively create a paid obligation without your agreement.

If a provision is unenforceable, it will be limited or removed only as much as needed and the rest remains effective. A failure to enforce is not a waiver. We may assign these Terms as part of a financing, reorganization, merger, or sale, subject to law and the Privacy Notice.
